Exemptions from overtime payments
Employers are required by overtime laws to pay their workers at a higher rate than the wage they would earn for regular work hours. As stated above, the standard threshold for most countries (including the U.S.A) is 40 working hours per week. The limit can be any, but some laws may have higher thresholds. In these cases, the employer should compensate for each hour above the standard threshold.
The Fair Labor Standards Act in the U.S. states that specific jobs can be exempted from overtime pay requirements. These jobs are known as exemptions. Employers are not required overtime pay in these cases. The non-exempt employees are employees generally eligible for overtime pay.
Certain overtime laws do not exclude workers from overtime rules. Some overtime laws exempt specific industries from overtime regulations.
